What is a DPO?

Data Protection Officer

The Data Protection Officer (DPO) is a role that must be filled within an organization in certain cases. The DPO has knowledge and experience with data protection legislation and can adequately supervise the controller designated by the DPO, as well as inform and advise the controller and its employees about the obligations imposed by the General Data Protection Regulation (GDPR).

  • Strengthen your privacy and information security with an experienced FG for adequate internal supervision and GDPR advice.
  • Our FG is the driving force behind privacy and information security, with independent oversight and reporting to the highest body.
  • Improve your governance by engaging a DPO for embedding and training, while taking the time to prepare internal staff.

When do you need an FG?

Other services

In most cases, it is clear when a DPO must be appointed, but sometimes this is not the case. Which organizations must appoint a DPO in any case? Government agencies and bodies, organizations that carry out regular and systematic large-scale monitoring, and organizations that process special categories of personal data (see Article 9 GDPR) or criminal convictions or offenses (see Article 10 GDPR).

Data Protection Officer

Why is a Data Protection Officer important for your organization?

Mandatory watchman

If an FG is mandatory under the GDPR, the appointment of an FG is unavoidable.

Contact person

The FG is therefore an anchor of the Dutch Data Protection Authority within your organization.

Important role

The role of the DPO is still evolving, but it is already clear that the Dutch Data Protection Authority attaches great importance to the opinions and advice of a DPO.

Strong content

The DPO must be knowledgeable in the field of the GDPR in order to be able to properly assist an organization with monitoring and complying with the GDPR.

Three Lines of Defens

Many organizations work according to the Three Lines of Defense model.

We believe that the DPO should be the driver of privacy and information security within an organization and, as such, should be part of the second line. The DPO manages privacy officers and security officers and, through them, provides advice and information to the executive organization, the first line. The DPO can supervise the frameworks provided by the second line and supervise the way in which the first line uses the frameworks in daily practice. The DPO operates independently and reports to the highest body within the organization.

An employee of your organization can be appointed as DPO. If governance around privacy and information security is well organized, this can work very well. If governance is not yet well established, it may be wise to outsource the role of DPO and its implementation for a certain period of time to a DPO with extensive knowledge and experience. The DPO can then set up the governance around privacy and information security. This gives you time to train an employee and, at the right moment, hand over the baton.
