Data Protection Officer
The Data Protection Officer (DPO) is a role that must be filled within an organization in certain cases. The DPO has knowledge and experience with data protection legislation and can adequately supervise the controller designated by the DPO, as well as inform and advise the controller and its employees about the obligations imposed by the General Data Protection Regulation (GDPR).

In most cases, it is clear when a DPO must be appointed, but sometimes this is not the case. Which organizations must appoint a DPO in any case? Government agencies and bodies, organizations that carry out regular and systematic large-scale monitoring, and organizations that process special categories of personal data (see Article 9 GDPR) or criminal convictions or offenses (see Article 10 GDPR).

We believe that the DPO should be the driver of privacy and information security within an organization and, as such, should be part of the second line. The DPO manages privacy officers and security officers and, through them, provides advice and information to the executive organization, the first line. The DPO can supervise the frameworks provided by the second line and supervise the way in which the first line uses the frameworks in daily practice. The DPO operates independently and reports to the highest body within the organization.
An employee of your organization can be appointed as DPO. If governance around privacy and information security is well organized, this can work very well. If governance is not yet well established, it may be wise to outsource the role of DPO and its implementation for a certain period of time to a DPO with extensive knowledge and experience. The DPO can then set up the governance around privacy and information security. This gives you time to train an employee and, at the right moment, hand over the baton.

What is the level of expertise of a DPO who is deployed at my organization, whether temporarily or permanently?
The Privacy CoOperation works exclusively with DPOs who have at least five years of experience in advising and supervising with regard to the GDPR. The Privacy CoOperation offers the appointed DPO a network of other DPOs, so that he or she can draw on a broad pool of knowledge and experience when necessary. This ensures that your organization receives the best possible support.
Can a DPO also be appointed for a short period, for example, because the current DPO is ill or has announced their departure from the organization?
The Privacy CoOperation offers the option of a ‘DPO as an e-service.’ You can appoint a DPO for the period you need to structurally fill the position (again).
Is my organization required to appoint a data protection officer?
In certain cases, an organization is required to appoint a DPO. For example, government agencies are required to appoint a DPO. Organizations that process data in a manner that, due to its nature, scope, and/or purpose, requires regular and systematic observation of data subjects on a large scale are also required to appoint a DPO. Finally, the appointment of a DPO is necessary if an organization processes special categories of data (such as medical data) or personal data relating to criminal convictions and offenses.
